As a Dallas maritime lawyer and Dallas boating accident lawyer, I am aware of how a fun outing on the water can turn into a nightmare. On September 12, 2010, eleven people, including eight children, were taken to the hospital after two boats crashed into each other near the Lewisville Lake Toll Bridge, which is north of Dallas. The boating accident happened at about noon when one of the boats "T-boned" the other. The boating accident involved two boats which were rented by the same group of people from a local boat rental company.

The boats were rented by three families from Garland. One of the boats sank after the collision. The boaters were rescued, and some of the injured were airlifted to various hospitals in the area. There was no indication that alcohol use contributed to the accident. Fortunately, everyone was wearing a life jacket.

The United States has about 12,000,000 registered boat owners. Unfortunately, there are hundreds of boating accident deaths, as well as thousands of injuries from boating accidents. As boats get faster, this will be an even bigger problem in the future. Some of the preventable reasons for these accidents include:

Boating under the influence of drugs or alcohol.

Careless, negligent or reckless operation of the boat.

The boat driver not paying proper attention.

Not being familiar with the waterway and its hazards.

  • Overloading or improperly loading the boat .
  • Boat operator inexperience.

    Careless or dangerous passenger behavior.

    Poor boat maintenance, and

    Going too fast for the water conditions.

    It is important to remember that lake levels are low now due to the drought. Thus, many obstacles that may have been hidden are in the water and could be hit. It is, of course, a good idea for all persons on board to wear a life jacket, especially at night or if the person cannot swim. Do not operate a boat under the influence of drugs or alcohol. Remember that a boat does not have brakes, and keep a good lookout for other boats.
